PiasaNet Service, Cancellation Policies, and Privacy Statement

PiasaNet, L.L.C. provides unlimited internet service to the River Bend area through a local telephone number. The PiasaNet service includes, with software owned by the PiasaNet subscriber, the availability of e-mail, newsgroups, web browsing, file transfer protocol (ftp) , telnet and gopher services. For the enjoyment of the PiasaNet subscribers, PiasaNet does not limit access to the internet.

Each PiasaNet subscriber is responsible for his/her activities on the internet and agrees to hold PiasaNet harmless. PiasaNet subscribers accept full responsibility for the activities of any person(s), including persons of minority age, accessing the internet using the subscriber's PiasaNet account. PiasaNet reserves the right to terminate any subscriber's account, if in the opinion of PiasaNet, the internet activities of the subscriber subject other PiasaNet subscribers to a limitation of service, including but not limited to a degradation of system performance or less than full accessibility to the internet.

Each PiasaNet Subscriber expressly agrees that use of the service, PiasaNet's e-mail services and the internet, are at the Subscriber's sole risk.  The service and  PiasaNet's e-mail services are provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied, unless such warranties are legally incapable of exclusion.  PiasaNet makes no warranties of any kind with respect to its E-Mail service and is not responsible for any message which may not be delivered or received as intended by the sender or the expected recipient.  Telephone charges are the responsibility of the PiasaNet Subscriber.  Each PiasaNet Subscriber is responsible for knowing what phone number his or her computer is dialing and what charges the PiasaNet Subscriber's local and/or long distance telephone company will assess to dial one of PiasaNet's modems lines.  PiasaNet has no responsibility to reimburse a PiasaNet Subscriber for any telephone charges.

PiasaNet's entire liability and a subscriber's exclusive remedy with respect to use of the service is limited solely to the amount paid by the PiasaNet Subscriber for access and use of the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states the provider's liability is limited to the extent permitted by applicable state law.

In consideration of the services provided by PiasaNet, each PiasaNet subscriber irrevocably agrees that, subject to PiasaNet's sole and absolute discretion, all suits, actions or other proceedings in any way, manner or respect arising out of or from or related to the Service shall be subject to litigation in court having suits in Edwardsville, Illinois; and  subscriber hereby waives trial by jury and consents and submits to the jurisdiction of any local, state, or Federal court located in Madison County, Illinois, and hereby waives any rights such PiasaNet subscriber may have to transfer or change the venue of any suit, action or proceeding arising in connection with the Service.

PiasaNet reserves the right to change its above mentioned policy at any time without notice.

PiasaNet recommends the use of virus protection software.

·Cancellation

Any subscriber may terminate the PiasaNet subscription upon proper notification to PiasaNet, L.L.C. Proper notification consists of: 1) Written correspondence mailed to PiasaNet, L.L.C. 2402 State Street Alton, IL. 62002. The correspondence should be signed by the PiasaNet subscriber; 2) An e-mail message addressed to piasasupport@piasanet.comTo verify the cancellation, the e-mail message must contain the user id and password of the account being canceled.

PiasaNet terminates accounts as of the end of the month the subscriber's cancellation notice is received. PiasaNet will return any prepaid subscription amounts in excess of the month of cancellation. Refunds will be mailed out at the end of the month in which the cancellation is received.
